Terms of Service
Last updated: 3 November 2026
These terms are an agreement between Bottalk Solutions Private Limited ("SoftTalk") and the business that signs up ("you"). By creating an account or using SoftTalk you accept them. Our Privacy Policy and SMS terms form part of these terms.
- The service. SoftTalk provides an AI receptionist that answers calls to your numbers, answers questions from the information you approve, takes messages, and where you enable it, books, reschedules and cancels appointments in your connected calendar.
- Your account. You must give accurate information, keep your login secure, and are responsible for activity on your account. You must be at least 18 and authorised to act for your business.
- Your information and instructions. You are responsible for the accuracy of the business information, prices, hours and booking rules you give SoftTalk. The receptionist relies on them.
- AI limitations. The receptionist can misunderstand callers or make mistakes, including in bookings. You should review calls, messages and bookings regularly. SoftTalk is not a substitute for emergency services and must not be used for medical, legal or emergency advice.
- Your legal duties. You are responsible for complying with the laws that apply to your calls and messages, including call-recording consent, telemarketing and text-message rules (such as the US TCPA), and privacy notices to your callers.
- Acceptable use. You may not use SoftTalk for unlawful, deceptive, harassing or spam calls or messages, to impersonate others, or to interfere with the service or other customers.
- Fees. You pay the prices agreed for your account, in the currency and billing units shown in your account (for example per call pulse). Prepaid balances are used as calls are handled. Fees are non-refundable except where the law requires or we agree in writing. We may change prices with 30 days' notice.
- Third-party services. SoftTalk relies on providers such as telephone carriers, AI providers and Google Calendar. Their outages or changes can affect the service; we are not responsible for third-party services we do not control.
- Data. You own your business information and call data. You let SoftTalk process it to provide the service, as described in our Privacy Policy. We act on your behalf for your callers' information.
- Availability. We work to keep SoftTalk available but do not guarantee uninterrupted service. We may change features, and will give notice of changes that significantly reduce the service.
- Suspension and ending. You can close your account at any time. We may suspend or close accounts that break these terms, fail to pay, or put the service or others at risk, with notice where reasonable.
- Warranty disclaimer. SoftTalk is provided "as is" to the extent the law allows, without warranties of fitness for a particular purpose or uninterrupted, error-free operation.
- Limitation of liability. To the extent the law allows, SoftTalk is not liable for indirect or consequential losses, including lost bookings, revenue or profits, and our total liability is limited to the fees you paid in the 3 months before the claim.
- Indemnity. You will cover SoftTalk for claims arising from your information, your calls and messages, or your breach of these terms or the law.
- Governing law. These terms are governed by the laws of India, and disputes go to the courts of Allahabad, unless the law where you are requires otherwise.
- Changes and contact. We may update these terms and will post the date above; significant changes are notified by email. Contact: anand@softtalk.in.
